Join us as we take a look at wage and hour issues facing employers today. We all know the horrors that can arise with issues stemming from failure to properly compensate employees for wages, miscalculating overtime, etc. But, wage and hour issues continue to have modern twists to them that can confuse even the best. We will take a look at these modern wage and hour issues facing employers including how leaves of absence such as FMLA and ADA accommodations impact compensation, wage issues arising from promotion and demotion of employees and the possible impacts of the Supreme Court’s decision in Ames and other recent case law, as well as the impact of more recent changes to state law on wage and hour compliance. This will be an interactive discussion so bring your questions!

Milena Radovic, Jackson Lewis

Milena Radovic is an associate in the Norfolk, Virginia, office of Jackson Lewis P.C. Her practice focuses exclusively on workplace law, including employment litigation, workplace training, and preventative client counseling.
Milena defends employers against claims brought under Title VII, ADA, ADEA, FMLA, FLSA, and tort claims, including assault and battery, intentional infliction of emotional distress, negligent hire and retention, and wrongful discharge, in both federal and state courts, in arbitrations as well as before federal, state, and local administrative agencies. Milena also provides clients with employee handbook review and training on a wide variety of employment topics. Milena also frequently presents on employment law related topics to local organizations and associations.
Prior to joining Jackson Lewis, Milena was a prosecutor in the Office of the Norfolk Commonwealth’s Attorney. She now uses her prosecution experience to defend management charged with criminal offenses stemming from workplaces incidents. During law school, Milena served as a manuscript editor of the Richmond Journal of Law and Technology. As a member of the University of Richmond School of Law Trial Advocacy Board, Milena competed and finished as an advancing finalist in the Virginia Trial Lawyers Association Trial Advocacy Tournament and regional runner-up in the American Association for Justice Regional Trial Advocacy Tournament. Milena received the Pro Bono Certificate from the Harry L. Carrico Center for Pro Bono & Public Service for performing more than 120 hours of pro bono service. While in law school, Milena externed for the Employment Unit of the Virginia Office of the attorney general and was a teaching assistant for Appellate Advocacy. Milena was also a research assistant for Professor Ann C. Hodges, and assisted her in the drafting of Public Sector Employment: Cases and Materials, (West 3d ed. 2016) and Modernizing Disability Income for Cancer Survivors, 35 Hofstra Lab. & Emp. L.J. 2 (Spring 2018).
Kristina H. Vaquera, Jackson Lewis
Kristina H. Vaquera is the Office Managing Principal and Office Litigation Manager of the Norfolk, Virginia, office of Jackson Lewis P.C. Her practice focuses exclusively on labor and employment advice and counseling and litigation.
Kristina represents employers in federal and state court lawsuits and agency charges and investigations covering a wide range of statutes and subjects, including anti-discrimination and civil rights laws, wrongful termination claims, disability accommodation and access, wage and hour laws, covenants not to compete and restrictive covenants, leave of absence claims, negligent hire/retention, and breaches of fiduciary duty and contract, as well as traditional labor issues, including bargaining and negotiations. Kristina has litigated class and collective actions, including FLSA, FCRA, and discrimination class actions. She also represents clients in grievances, mediations, arbitrations, and charges before various national and state entities.
Kristina is a key member of the national core counsel team, providing expert advice and counsel on a wide range of legal matters. She has extensive experience in conducting investigations and delivering training sessions.
As part of Kristina’s counseling practice, she provides daily advice and counseling and training to management to proactively assist employers in avoiding litigation. She assists clients with employment agreements, handbooks, background checks and drug testing issues, and disciplinary action. She represents employers before the Equal Employment Opportunity Commission, National Labor Relations Board, Department of Labor, and numerous state agencies, such as the Virginia Employment Commission, Virginia Department of Labor and Industry, Virginia Department of Housing Discrimination, and Virginia Worker’s Compensation Commission.
